    Welcome to another edition of the Florida Appellate Review Case Law Update. In this week’s episode, our founder, Board-Certified Appellate Attorney Andrew Harris, joined by Jennifer Dinetz and Jeff Adelman, discussed a series of cases addressing:

    •Whether insurance adjusters and a medical doctor’s affidavits were properly stricken by the trial judge, where the affidavits addressed the reasonableness of medical costs and whether medical treatment was reasonably related to the subject motor vehicle accidents;
    •Whether an adverse inference instruction was warranted in an Engle progeny case where a plaintiff shredded medical records, including the circumstances in which a duty to preserve evidence arises, and whether a duty to preserve evidence is required before an adverse inference instruction is given by a trial judge; and
    •Whether a hotel was entitled to summary judgment in a negligence case, where an invitee fell in an unbeveled 3/8 inch change in evaluation between the tiled entryway and the carpeted floor of the hotel room.

    •A $10 million dollar plaintiff’s verdict reversed due to a series of improper closing arguments by a trial attorney who was criticized out yet again by the Fourth District Court of Appeal for improper closing arguments in Engle progeny cases;

    •The distribution of attorneys’ fees between partners in a contingency case when one partner leaves the Firm, where there is partnership agreement addressing fees ; and

    •Whether Proposals for Settlement and other documents served (but not filed) must comply with the electronic service requirements for court-filed documents.

    •An Engle progeny case where an attorney’s improper closing argument resulted in a new trial;
    •The “boarding” of past medical bills for a plaintiff who is a Medicare recipient, with the Fourth District certifying a question of great public importance to the Florida Supreme Court; and
    •An appellate court’s referral of an attorney to the Florida Bar after the attorney engaged in improper conduct towards the opposing party and opposing counsel in trial proceedings.

    On Thursday April 29, 2021, the Florida Supreme Court released an administrative order changing the standard Florida State Judges are to use when ruling on Motions for Summary Judgment.

    The next day, Friday April 30, 2021, ABOTA produced a webinar that included an outstanding panel featuring: Broward Judges Carol-Lisa Phillips, Jeffrey Levenson, United States District Court (Southern District of Florida) Judge Raag Singhal, Board Certified Appellate Lawyer Andrew Harris, and longtime ABOTA member and Past-President of the Fort Lauderdale Chapter, Joe Kashi. The program was moderating by ABOTA Fort Lauderdale President Brent Reitman.

    The panel discussed Florida’s migration to the Celotex standard already in use in Federal Courts. The Judges and Lawyers discussed the theoretical and practical implications of this evolution in Summary Judgment litigation.
