Ce court roman de Victor HUGO est inspiré par un fait divers ayant eu lieu le 7 novembre 1831 : Claude Gueux, voleur de nourriture par nécessité est emprisonné à la centrale de Clairvaux, ou il finit par tuer celui qui le brime M. Delacelle, le directeur des ateliers, ceci devant d'autres détenus manifestant leur soutien. Il est condamné à mort et exécuté en juin 1832. En 1834, Victor HUGO publie sa version du fait divers dans la "Revue de Paris" suivie d'un vibrant plaidoyer contre la peine de mort et d'une partie argumentative sur les lacunes de la société qui conduisent à de telles condamnations à mort.
